Terms of service
These terms are an agreement between you and [Company legal name] (OPC) Private Limited (“ChargeSaathi”, “we”, “us”). They cover your use of the ChargeSaathi app and website (the “Platform”). By creating an account you accept them. If you do not agree, do not use the Platform.
Important: ChargeSaathi is a marketplace that connects drivers with hosts. We do not own or operate the chargers and we do not sell electricity. Each charging session is an arrangement between a driver and a host, and they are responsible for it.
Who can use ChargeSaathi
- You must be at least 18 and able to enter a binding contract under Indian law.
- You must give accurate information and keep it up to date.
- One person, one account. You are responsible for everything done through your account.
Our role
ChargeSaathi is an intermediary under the Information Technology Act, 2000. We provide the technology that lets hosts list chargers, lets drivers request them, and records the session. We are not a party to the arrangement between a driver and a host. We do not inspect, certify or guarantee any charger, location, vehicle or user.
If you are a host
By listing a charger, you confirm and agree that:
- Your electricity supply. You are allowed to use your connection to charge other people's vehicles, and to accept money for it. You will follow your electricity distribution company's (for example TANGEDCO/TNPDCL) tariff conditions, the Ministry of Power's EV charging guidelines, and any local, housing-society or landlord rules. You alone are responsible for this.
- Safe equipment. Your charger, socket and wiring are properly rated for EV charging, correctly earthed and protected (for example with an RCD/RCCB), and installed by a qualified electrician. You will never offer an extension cord or a damaged outlet.
- Accurate listing. The location, connectors, power, price, hours and access instructions are accurate. You keep the listing switched off when the charger is not available.
- Your premises. You give drivers safe access to the parking spot during the agreed session.
- Taxes. You are responsible for any income tax, GST or other taxes on what you earn.
- Insurance. We recommend that you have suitable insurance for your property and equipment.
If you are a driver
- Your vehicle and cable are compatible with the host's connector, and you will follow the vehicle maker's charging instructions.
- You will follow the host's parking and access instructions, respect their property and leave on time.
- You will pay the amount shown in the app when the session ends.
- You are responsible for any damage you or your vehicle cause to the host's property.
Bookings, sessions and pricing
- A booking is confirmed only when the host accepts it. Hosts may decline any request.
- The host starts and stops the session in the app. The amount is the host's hourly price, billed for each started 15-minute block, with a minimum of 15 minutes.
- Before a session starts, the driver can cancel a requested or accepted booking at no charge. See our Refunds & cancellations policy.
Payments
- At present, drivers pay hosts directly through their own UPI apps. ChargeSaathi does not receive, hold or transfer this money, and does not charge drivers or hosts a fee.
- The host confirms in the app when payment arrives. Payment disputes are between the driver and the host. We may help with the records from the app (see Disputes).
- We may later add in-app payments through a licensed payment gateway, and a platform or convenience fee. We will update these terms and tell you before any fee applies.
What you must not do
- Break any law, or use the Platform for fraud, harassment or to harm anyone.
- Post false, misleading, offensive or infringing content, or fake reviews.
- Agree a booking through ChargeSaathi and then take payment outside the app to avoid the records, or after a future platform fee is introduced, to avoid that fee.
- Collect other users' data, or use contact details for anything other than the booking.
- Interfere with the Platform's security, or reverse-engineer it.
Ratings and content
Drivers may rate hosts after a paid session. You keep ownership of what you post. You give us a non-exclusive, royalty-free licence to display it on the Platform. We may remove content or listings that break these terms or the law.
Safety and disclaimers
EV charging involves electricity and moving vehicles. Use your own judgement: inspect the equipment before plugging in, and stop at once if anything seems unsafe. The Platform is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, including that any charger is safe, available, legal to use or fit for your vehicle.
Limitation of liability
To the extent the law allows, ChargeSaathi is not liable for indirect, incidental or consequential losses. It is also not liable for loss or damage arising from a charging session, a charger, electricity supply, premises, vehicles or the conduct of users. Our total liability to you for any claim is limited to the greater of ₹1,000 or the fees (if any) you paid us in the 3 months before the claim. Nothing in these terms limits liability that cannot be limited under Indian law.
Indemnity
You agree to indemnify ChargeSaathi against claims, losses and costs arising from your breach of these terms, your listing or charging session, or your violation of any law or third-party right. This includes electricity-supply and tariff rules.
Suspension and termination
You may stop using the Platform and delete your account at any time. We may suspend or end your access if you break these terms, if the law requires it, or to protect other users. We will give notice where reasonable.
Disputes
If something goes wrong with a session, first try to resolve it with the other user. You can also contact us at support@chargesaathi.in, and we will share the session records from the app and try to help. Disputes with ChargeSaathi will first be handled through our grievance process.
Governing law and jurisdiction
These terms are governed by the laws of India. Subject to the grievance process above, the courts at Chennai, Tamil Nadu have exclusive jurisdiction.
Changes to these terms
We may update these terms. For significant changes, we will tell you in the app or by email at least 15 days before they take effect. If you continue to use the Platform after that, you accept the updated terms.
